1. Who we are
VyuMee is operated by VyuMee Ltd (“VyuMee”, “we”, “us” or “our”), a company registered in England and Wales under company number 17439372.
Registered office: 167–169 Great Portland Street, 5th Floor, London, W1W 5PF.
General support: support@vyumee.co.uk
Legal enquiries: legal@vyumee.co.uk
2. These Terms
These Terms govern your access to and use of VyuMee websites, applications and platform services that link to or present these Terms (the “Service”).
By creating an account, or by continuing to use an account after being asked to accept these Terms, you agree to these Terms. Where VyuMee records an affirmative acceptance, the accepted document version is stored as part of VyuMee’s legal acceptance record.
If you do not agree to these Terms, do not create or use a VyuMee account.
Some VyuMee features are subject to additional terms or policies. If additional terms apply to a feature, they will be presented or made available before that feature is enabled or used. If there is a conflict, the more specific terms govern that feature to the extent of the conflict.
Nothing in these Terms removes rights that applicable law says cannot be excluded or restricted.
3. Pre-launch status and age
VyuMee is currently in pre-launch development. Some features described on VyuMee may not yet be available, and public registration, live creator payments and adult/explicit web functionality may remain disabled until their applicable launch gates are complete.
Any account access VyuMee makes available during the pre-launch period is for people aged 18 or over unless VyuMee expressly provides a different age-appropriate flow.
Creators, Founding Creators, users receiving creator monetisation capabilities, and anyone seeking access to any adult or explicit area must be at least 18 and must complete any age, identity, seller, tax, payment or other verification required for the relevant capability.
The minimum age rules for any future general public fan registration will be confirmed before that registration is enabled, following VyuMee’s children-access and safety assessment. If those rules materially change these Terms, VyuMee will publish a new version and require acceptance where appropriate.
You must not bypass or help another person bypass age, identity or eligibility controls.
4. Your account
You must provide information that is accurate in all material respects and keep information reasonably up to date where VyuMee asks you to do so.
You are responsible for maintaining the confidentiality and security of your login credentials and for activity carried out through your account, except to the extent that activity results from VyuMee’s failure to provide the Service with reasonable care and skill or from circumstances for which the law makes VyuMee responsible.
You must tell us promptly if you reasonably believe your account or credentials have been compromised.
You may not sell, transfer, rent or give another person your account, except where VyuMee expressly permits a managed business or team account.
VyuMee may require re-authentication, identity checks or other reasonable security steps before allowing sensitive changes.
5. Using VyuMee
You may use the Service only for lawful purposes and in accordance with these Terms and any operative policy that applies to the feature you are using.
You must not:
- use the Service to commit, facilitate, encourage or promote unlawful activity;
- upload, share or request content that is unlawful or that VyuMee is required to restrict or remove;
- impersonate another person or organisation, or materially misrepresent your identity or authority;
- infringe another person’s intellectual property, privacy, publicity or other rights;
- harass, threaten, exploit, defraud or deliberately deceive other users;
- attempt to gain unauthorised access to accounts, systems, data or security controls;
- introduce malware or use the Service to distribute malicious code;
- scrape, harvest or access the Service by automated means in a way that circumvents technical controls or materially interferes with the Service;
- manipulate engagement, fraudulently obtain payments or benefits, or interfere with ranking, reporting or moderation systems;
- evade a suspension, restriction or ban by creating or using another account; or
- use mobile STORE clients to seek, publish or distribute content classified by VyuMee as WEB_ONLY_ADULT.
VyuMee may publish more detailed Acceptable Use, Community, safety and content policies. Until those policies become operative, the restrictions in this section apply directly.
6. Your content and ownership
You keep ownership of intellectual property rights you hold in content you submit to VyuMee (“Your Content”). These Terms do not transfer ownership of Your Content to VyuMee.
You give VyuMee a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt for technical purposes, transmit, display and otherwise use Your Content only as reasonably necessary to:
- operate, secure and provide the Service;
- deliver Your Content to audiences and features you choose;
- moderate, review and enforce platform rules;
- make technical changes needed for different devices, formats and networks; and
- comply with law, valid legal process and VyuMee’s legal obligations.
This licence allows VyuMee to use service providers acting on VyuMee’s behalf for those purposes. It does not give VyuMee ownership of Your Content.
The licence ends when Your Content is deleted from the Service, except to the extent copies remain temporarily in backups, are needed to complete an action you requested, were shared with others in a way that cannot reasonably be recalled, or must be retained for legal, safety, fraud-prevention, dispute or evidential purposes.
You confirm that you have the rights and permissions needed to submit Your Content and grant the licence above.
7. VyuMee content, software and branding
The Service, software, interfaces, designs, VyuMee name, logos, badges and other materials supplied by VyuMee are owned by VyuMee or its licensors and are protected by applicable intellectual property laws.
Subject to these Terms, VyuMee gives you a personal, limited, revocable, non-exclusive and non-transferable permission to access and use the Service for its intended purpose.
You may not copy, sell, licence, reverse engineer or commercially exploit VyuMee software, branding or protected materials except where law permits it or VyuMee gives written permission.
Creator status badges, including Founding Creator numbers, identify platform status only. They do not represent ownership, equity, employment, partnership, agency, investment rights or a guarantee of earnings or exposure.
8. Creators and creator-specific terms
A creator account may be subject to additional onboarding, verification and contractual requirements before creator, monetisation or payout capabilities are enabled.
The Creator Agreement and, where applicable, the Founding Creator Addendum, payments terms, fan-to-creator transaction terms and adult-content policies govern those specific capabilities once they become operative.
Receiving a creator account, status label or Founding invitation does not itself guarantee monetisation, payments, distribution, audience, ranking, sponsorship or continued access to any discretionary programme benefit.
9. Adult and explicit content
VyuMee’s iOS and Android STORE clients do not permit adult or explicit content designated as WEB_ONLY_ADULT.
Any future adult or explicit functionality is web-only and remains disabled unless and until VyuMee enables the relevant age-assurance, creator/performance verification, consent, moderation, payment and legal controls.
No user has a right to access or publish adult or explicit content merely because the Service or these Terms refer to that possible functionality.
10. Paid features, subscriptions and purchases
Live payment collection and creator payouts may remain disabled during pre-launch.
Before VyuMee enables a paid feature, the applicable price, billing frequency, material transaction terms and any additional cancellation or refund information will be shown or made available as required for that transaction.
Payments may be processed by Apple, Google or a regulated payment provider. Additional store or payment-provider terms may apply.
Where applicable law gives you cancellation, refund, digital-content or service rights, these Terms do not remove those rights.
VyuMee may use separate terms for creator transactions, subscriptions, refunds, payments, earnings, payouts and chargebacks. Those terms become binding only when made operative and incorporated into the relevant transaction or creator relationship.
11. Third-party services and links
The Service may depend on or link to third-party services, app stores, payment providers or websites. Third parties may apply their own terms and privacy notices.
VyuMee is not responsible for third-party services that it does not control, but nothing in this section excludes responsibility that applicable law places on VyuMee.
12. Moderation, restrictions and enforcement
VyuMee may investigate suspected breaches of these Terms, safety concerns, fraud, security incidents or legal obligations.
Where reasonably necessary and proportionate, VyuMee may restrict content or features, remove content, limit distribution, require additional verification, temporarily suspend an account or terminate access.
Where appropriate and legally permitted, VyuMee will provide notice or reasons and access to any applicable review or appeal process. VyuMee may act without prior notice where reasonably necessary to address urgent safety, security, fraud, legal or evidential risks.
Enforcement action does not automatically erase records that VyuMee must or may lawfully retain for safety, fraud prevention, disputes, legal compliance or evidence.
13. Availability and changes to the Service
VyuMee is developing the Service and may add, remove, test, modify or discontinue features.
We do not promise that every feature will always be available or uninterrupted. Planned or emergency maintenance, technical failures, security incidents and third-party dependencies may affect availability.
If VyuMee makes a change that materially affects a paid consumer service, VyuMee will respect any rights and remedies that applicable law provides.
14. Ending your use of VyuMee
You may stop using VyuMee at any time.
Account closure and deletion options will be provided through VyuMee’s applicable account controls and published deletion route before public launch. Some information may be retained after closure where necessary and lawful, including for transaction records, tax, fraud prevention, safety, legal claims, regulatory obligations and evidence of legal acceptance.
VyuMee may suspend or terminate access in accordance with section 12.
Sections that by their nature need to continue after account closure remain effective, including provisions concerning ownership, licences already needed for retained copies, legal records, disputes and liability.
15. Our responsibility to consumers
VyuMee will provide its own consumer services with the rights and standards required by applicable law.
VyuMee does not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
If you use VyuMee as a consumer, VyuMee is responsible for losses that are a foreseeable result of VyuMee breaching these Terms or failing to use reasonable care and skill. VyuMee is not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses suffered by a consumer acting wholly for personal purposes.
Nothing in these Terms excludes or restricts statutory consumer rights.
Creator or business users may be subject to additional liability provisions in the Creator Agreement or another business-specific contract.
16. Events outside reasonable control
VyuMee is not responsible for delay or failure caused by events outside its reasonable control to the extent permitted by law. This does not affect rights that applicable consumer law gives you.
17. Changes to these Terms
VyuMee may update these Terms to reflect changes to the Service, law, regulation, safety requirements or business operations.
The current version, effective date and canonical URL will be published at https://vyumee.co.uk/legal/terms.
For material changes affecting account holders, VyuMee will provide reasonable notice where appropriate and will require affirmative acceptance where the nature of the change or applicable law requires it.
The legal acceptance record may store the version, effective date, canonical URL and cryptographic digest of the Terms you accepted.
18. Privacy
VyuMee’s Privacy Notice explains how personal data is handled. Feature-specific privacy notices may also apply.
Privacy notices describe data processing; they are not used to remove rights provided by data protection law.
19. Complaints and contact
For general support or a complaint, contact support@vyumee.co.uk.
For legal notices or legal questions, contact legal@vyumee.co.uk.
Additional reporting, safety, copyright, privacy and appeal routes will be made available as the corresponding platform functions become operational.
20. General legal terms
If any part of these Terms is found unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
A delay by VyuMee in enforcing a right does not waive that right.
You may not transfer your rights or obligations under these Terms to another person without VyuMee’s written agreement. VyuMee may transfer its rights or obligations as part of a reorganisation, financing, sale or transfer of the Service, provided this does not reduce mandatory consumer protections.
Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between VyuMee and an ordinary user.
Except where a more specific contract says otherwise, a person who is not a party to these Terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
21. Governing law and courts
These Terms are governed by the law of England and Wales, subject to any mandatory protections that apply to you as a consumer in the place where you live.
If you are a consumer, nothing in this section prevents you from using any court or dispute right that applicable law makes available to you.
If you are using VyuMee for business purposes and no more specific agreement applies, the courts of England and Wales have exclusive jurisdiction.
